1. About Us

These Terms of Service ("Terms") govern the use of the MoDroneView Ltd website and the drone photography, videography, and 360° virtual tour services we provide.

2. Our Services

We provide:

• Aerial photography using unmanned aerial vehicles (drones)
• Aerial videography and cinematic video production
• 360° virtual tour creation and hosting
• Associated editing, colour grading, and post-production

All services are subject to availability, weather conditions, and airspace restrictions.

3. Booking and Payment

• All bookings must be confirmed in writing (email or WhatsApp).
• A booking is only confirmed once we have acknowledged acceptance of the booking.
• Pricing will be agreed in writing before any shoot takes place.
• Payment terms will be specified on the invoice. Standard terms are payment within 14 days of invoice.
• We reserve the right to withhold delivery of files until payment is received in full.

4. Cancellations and Rescheduling

• Cancellations made more than 48 hours before a scheduled shoot will incur no charge.
• Cancellations made with less than 48 hours' notice may be subject to a cancellation fee of up to 50% of the agreed fee.
• We reserve the right to reschedule or cancel a shoot due to adverse weather, unsafe flying conditions, airspace restrictions, or other circumstances beyond our control. In such cases, no charge will be made and we will reschedule at the earliest convenient date.

5. Drone Operations

MoDroneView Ltd operates in accordance with the UK Drone and Model Aircraft Code. We hold a valid CAA Operator ID and Flyer ID. We will check airspace restrictions before each shoot and will not fly in restricted or prohibited zones.

Clients must ensure that we have legal right of access to the shoot location and that the shoot does not violate any property rights, privacy rights, or local restrictions.

6. Intellectual Property

All images, video, and content produced by MoDroneView Ltd remain the intellectual property of MoDroneView Ltd until full payment has been received.

Upon receipt of full payment, the client is granted a non-exclusive, royalty-free licence to use the delivered content for the agreed purpose (typically property marketing). This licence does not include resale or sub-licensing of the content to third parties without prior written agreement.

MoDroneView Ltd retains the right to use any produced content in its portfolio, website, and marketing materials unless the client requests otherwise in writing before the shoot.

7. Privacy and Data

We collect and process personal data in accordance with our Privacy Policy, which forms part of these Terms.

Drone photography may capture images of third parties or neighbouring properties. We will comply with any reasonable requests to avoid capturing identifiable individuals. Clients are responsible for notifying affected parties where required by law or local planning conditions.

8. Limitation of Liability

MoDroneView Ltd holds public liability insurance. Our total liability for any claim arising from our services shall not exceed the total fees paid for the specific shoot in question.

We are not liable for indirect, consequential, or economic losses arising from any delay, cancellation, or failure to deliver, including losses caused by circumstances beyond our reasonable control (force majeure).

9. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Changes to These Terms

We may update these Terms from time to time. The version in force at the time of your booking confirmation will apply to that booking.
